Spain: Mandatory prison of up to three years for Servicio-IPTV pirates. Harshest penalty yet

The Spanish pirate Web sites servicio-iptv, servicioiptvcam and servicioiptvpremium were closed permanently by order of the Provincial Court of Malaga for infringement under Spain’s Intellectual Property Law.

The original complaint by Movistar+ (Telefonica’s premium video service) had alleged that the parties offered subscription-based access to more than 8,000 domestic and international TV channels.  Monthly, quarterly, semi-annual and annual subscriptions were offered; the annual rate being €50.

The complaint was later joined by members of ADIVAN (Asociación de Distribuidores e Importadores Videográficos de Ámbito Nacional), members of which include The Walt Disney Company, Sony Pictures Entertainment Iberia and 20th Century Fox Home Entertainment Spain.

The parties behind the sites were sentenced to fines and mandatory prison sentences of up to three years. Until now the courts had allowed the suspension of convictions in similar situations.

Actions by the Central Cybercrime Unit of Spain’s National Police dismantled the service delivery and payment processing infrastructures.

Why it matters

According to local reporting, the sentence for this case was greatly escalated, compared with penalties in previous cases which carried shorter sentences or no prison time at all.

It could have been worse: the defendants had voluntarily acknowledged the facts of the case, which resulted in a reduction in penalties.  That bargain also eliminated the possibility of an appeal.
